1. Acceptance of Terms

Welcome to HireAligned! By accessing or using our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use our services.  

2. Description of Services

HireAligned provides tools and services that help candidates benchmark their culture and identify candidates who align with it. We reserve the right to modify or discontinue any part of our services at any time.

3. User Accounts

• Account Creation: You may be required to create an account to access certain features. You agree to provide accurate and complete information when creating your account.  

• Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.  

• Account Termination: We reserve the right to suspend or terminate your account at our discretion, without notice, for violations of these Terms.  

4. User Content

• Responsibility: You are solely responsible for any content you post, upload, or transmit through our services.

• Ownership: You retain ownership of your content, but you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute your content in connection with providing our services.  

• Prohibited Content: You agree not to post content that is illegal, harmful, offensive, or infringing on the rights of others.

5. Payment and Billing

• Fees: You agree to pay all applicable fees for our services.

• Billing: Fees will be billed as described on our website or in your subscription agreement.

• Pricing Adjustments:

  • Our pricing is based on your anticipated usage of HireAligned, including but not limited to the expected number of hires within a specific timeframe, the number of team members included in organizational benchmarking, and the number of hiring manager logins.

  • We reserve the right to review and adjust your pricing based on actual usage. If your actual usage significantly exceeds your initial projections (e.g., you stated you would hire 3 people in a year but hired 5 in the first quarter, or you added multiple team members or hiring managers), we may increase your fees to reflect the increased usage.

  • Conversely, if your actual usage is significantly below your initial projections (e.g., you stated you would hire 10 people in a year but have hired none after 6 months), we may review and reduce your fees to better align with your current usage.

  • Adding more team members, or hiring manager logins will also cause a price increase.

  • We will provide reasonable notice of any pricing adjustments.

• Refunds: Our refund policy is outlined in our separate Refund Policy document.

6. Intellectual Property

• Our Content: All content on our platform, including text, graphics, and software, is the property of HireAligned or its licensors and is protected by intellectual property laws.

• Your Use: You agree not to copy, modify, or distribute our content without our express written permission.

7. Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted or error-free.  

8. Limitation of Liability

In no event shall HireAligned be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services.

9. Indemnification

You agree to indemnify and hold HireAligned harmless from any claims, damages, or expenses arising out of your use of our services or your violation of these Terms.  

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.  

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of our services after any changes constitutes your acceptance of the new Terms.
